ప్రఖ్యాత ''గోలక్ నాథ్'' కేసులో [[సుప్రీం కోర్టు|భారత అత్యున్నత న్యాయస్థానం]] మౌలికాంశాలైన ప్రాథమిక హక్కులు వంటివాటిని ప్రభావితం చేస్తూన్నప్పుడు [[భారత రాజ్యాంగం|రాజ్యాంగాన్ని]] పార్లమెంటు సవరించకూడదని వ్యాఖ్యానించింది. ఈ తీర్పును రద్దుచేస్తూ ఇందిర నేతృత్వంలోని కాంగ్రెస్ ఆధిక్యతలో ఉన్న పార్లమెంట్ 1971లో ప్రాథమిక హక్కులను ప్రభావితం చేసేలాంటి రాజ్యాంగ సవరణలు కూడా చేయొచ్చన్న 24వ సవరణ ఆమోదించింది. పూర్వపు రాజులు, జమీందార్లకు ఇచ్చిన రాజాభరణాలు రద్దుచేస్తూ తీసుకున్న నిర్ణయాన్ని సవాలు చేస్తూ దాఖలైన వ్యాజ్యంలో సుప్రీంకోర్టు ప్రభుత్వానికి వ్యతిరేకమైన తీర్పునిస్తే 26వ సవరణ తీసుకువచ్చారు. దానిలో భాగంగా సుప్రీంకోర్టు తీర్పును రద్దుచేసే విధంగా రాజభరణాల రద్దును రాజ్యాంగబద్ధం చేశారు. ఈ న్యాయవ్యవస్థ-శాసనవ్యవస్థల నడుమ యుద్ధం చారిత్రాత్మక ''కేశవానంద భారతి'' కేసు వరకూ కొనసాగింది. ఈ కేసు తీర్పులో 24వ సవరణ ప్రశ్నించబడింది. అతికొద్ది 7-6 ఆధిక్యతతో, సుప్రీంకోర్టు ధర్మాసనం పార్లమెంటుకు రాజ్యాంగాన్ని సవరణ చేసే హక్కును నియత్రిస్తూ రాజ్యంగ మౌలిక నిర్మాణాన్ని మార్చేందుకు వినియోగించరాదని తీర్పునిచ్చింది. తదనంతరం కేశవానంద భారతి కేసులో తీర్పుని వ్యతిరేకించిన మైనారిటీలోకెల్లా సీనియర్ అయిన ఎ.ఎన్.రే ని భారత ప్రధాన న్యాయమూర్తిగా ప్రధాని ఇందిర నియమించారు. ఈ నియామకంలో తీర్పుకు అనుకూలమైన మెజారిటీలోని ముగ్గురు సీనియర్ జడ్జిలు - జె.ఎం.షెలాత్, కె.ఎస్.హెడ్గే, గ్రోవర్ లను అధిగమించి రేని పదవి వరించింది. స్వతంత్రంగా ఉండాల్సిన న్యాయవ్యవస్థను ఇందిర నియంత్రించే ప్రయత్నాలు చేయడాన్ని అటు పత్రికలు, ఇటు [[లోక్ నాయక్ జయప్రకాశ్‌ నారాయణ్‌|జయప్రకాశ్ నారాయణ్]] వంటి ప్రత్యర్థుల నుంచి తీవ్ర విమర్శలు వచ్చాయి.
