వై.వి. చంద్రచూడ్: కూర్పుల మధ్య తేడాలు

'''యశ్వంత్ విష్ణు చంద్రచూడ్''' ({{lang-mr|यशवंत विष्णू चंद्रचूड}}) (12 జూలై 1920 – 14 జూలై 2008) 16వ భారతదేశ ప్రధాన న్యాయమూర్తిగా 1978 ఫిబ్రవరి 22 నుండి 1985 జూలై 11 వరకు పనిచేశాడు. భారత దేశ చరిత్రలో అత్యధిక కాలం 7 సంవత్సరాల, 4 నెలలు భారత ప్రధాన న్యాయమూర్తిగా పనిచేసిన వ్యక్తిగా ఇతడు ప్రసిద్ధుడు.

భారత రాజ్యాంగ చరిత్రలో ఈ కేసు అత్యంత ప్రాముఖ్యతను సంతరించుకుంది. [[ఇందిరా గాంధీ]] ప్రధానిగా ఉన్నప్పుడు విధించిన [[భారత అత్యవసర స్థితి]] (1975-1977) సమయంలో ఐదు మంది సుప్రీం కోర్టు సీనియర్ జడ్జిలతో కూడిన ధర్మాసనం ఈ హెబియస్ కార్పస్ కేసు విచారణను చేపట్టింది.([http://www.pucl.org/reports/National/2001/habeascorpus.htm A.D.M. The Indian constitution during that time itself provided that all fundamental rights, including the right to life under article 21 of the constitution, could be suspended during an Emergency. The Habeas Corpus majority decision therefore deferred to the original intent of the framers of India's constitution. However, the Indira Gandhi government flagrantly misused their powers during the Emergency, and as a result, the doctrine of "original intent" has never taken a firm hold in India.
